Nitish Kumar Steps Down from Bihar Legislative Council, Spotlight Shifts to Next Chief Minister

Nitish Kumar and Nitin Nabin on Monday submitted their resignations from the Bihar Legislative Council and Bihar Legislative Assembly, respectively.

Both leaders sent their resignation letters through representatives. MLC Sanjay Gandhi, along with Parliamentary Affairs Minister Vijay Kumar Choudhary, delivered Nitish Kumar’s letter to Council Chairman Avadhesh Narayan Singh. Meanwhile, BJP state president Sanjay Saraogi submitted Nabin’s resignation to the Assembly Speaker.

Avadhesh Narayan Singh confirmed that Nitish Kumar’s resignation has been accepted, praising his contribution as a dedicated leader committed to Bihar’s development.

Both Nitish Kumar and Nitin Nabin were elected to the Rajya Sabha on March 16, making it mandatory for them to resign from the state legislature by March 30. As per the Prohibition of Simultaneous Membership Rules, 1950, under Articles 101 and 190 of the Constitution, a person cannot hold membership in both Parliament and a state legislature simultaneously and must step down from one within 14 days.

Sanjay Saraogi stated that Nabin had already handed over his resignation before leaving Patna due to prior commitments in Delhi and Assam. Nabin also shared an emotional message for the people of Bankipore, the constituency he has represented since 2006, assuring them that his connection with them would remain strong despite his new responsibilities.

Vijay Kumar Choudhary said Nitish Kumar had entrusted his resignation letter to Sanjay Gandhi for submission, emphasizing that the move reflects his consistent commitment to constitutional norms.

On being asked about Nitish Kumar stepping down as Chief Minister, Choudhary said the decision would be taken at the appropriate time following constitutional procedures.

Nitish Kumar is expected to resign as Chief Minister before taking oath as a Rajya Sabha MP. With his exit from the state legislature, focus now shifts to who will succeed him, potentially marking a major political transition in Bihar after more than two decades of his leadership.
